DESMA Center Provides Recommendations in the Regular Meeting of the Working Group for the Analysis and Evaluation of Regional Tourism Law

DESMA Center as a member of the Working Group for Legal Analysis and Evaluation related to DKI Jakarta Provincial Regulation Number 6 of 2015 concerning Tourism was present at a regular meeting of discussions on August 15, 2022. This meeting was held at the Regional Office of the Ministry of Law and Human Rights (Kemenkumham) DKI Jakarta. The meeting was opened by the Head of Legal Affairs (Alfik Abdullah) accompanied by the Head of the Sub-Division of Facilitation of the Formation of Regional Legal Products (Erinawita) and was attended by other members of the Working Group consisting of the DKI Jakarta Provincial Tourism and Creative Economy Office, DESMA Center, JFT Legal Analysts, JFT Drafting Laws and Regulations, and JFU.
This meeting presented Prof. Dr. Azril Azhari, Chairman of the Indonesian Tourism Scholars Association, as a resource person. He explained the concept of tourism and regulatory analysis of the Tourism Law, the Job Creation Law and the Tourism Bylaws.
DESMA Center giving the recommendation so that the definitional boundaries of tourism are expanded by involving the sustainable tourism component, as well as encouraging tourism in DKI Jakarta to be held with the aim of considering the concept of sustainable tourism so that implementation in the field can run optimally.

This meeting activity is expected to help the Working Group to capture important issues related to tourism and its implementation in the field that have an effect in future arrangements.
The results of legal analysis and evaluation activities related to DKI Jakarta Provincial Regulation Number 6 of 2015 concerning Tourism are in the form of recommendations on the status of existing laws and regulations, whether they need to: (1) improvement (revision); (2) reimbursement (repeal); or (3) maintained in order to effectively implement this Bylaw.

In order to carry out regional legal analysis and evaluation activities for fiscal year 2022, the Regional Office of the Ministry of Law and Human Rights of DKI Jakarta has established a Working Group on Legal Analysis and Evaluation regarding DKI Jakarta Regional Regulation Number 6 of 2015 concerning Tourism. DESMA Center is part of the working group.
The House of Representatives of the Republic of Indonesia passed Law Number 11 of 2020 concerning Job Creation on October 5, 2020, which was subsequently promulgated on November 2, 2020. The Job Creation Law is the first legal product in Indonesia with the concept of Omnibus Law. The logical consequence with the promulgation of the Job Creation Law is the establishment of implementing regulations that will spell out further provisions regarding the regulated substance.
This will certainly change the laws and regulations at the local regulatory level. Apart from the impact of the Job Creation Law, there are several provisions in Regional Regulation Number 6 of 2015 concerning Tourism that are no longer relevant. Ideally, the plan for the preparation of draft regional regulations affected by the existence of the Job Creation Law is prepared by paying more attention to the characteristics of regional specificities, in this case DKI Jakarta Province.
