DESMA Center's discussion with the Jakarta Regional Office of the Ministry of Law and Human Rights on Legal Analysis and Evaluation of DKI Jakarta Regional Regulation Number 6 Year 2015 on Tourism

In order to implement the activities of Analysis and Evaluation of Regional Laws for Fiscal Year 2022, the Regional Office of the Ministry of Law and Human Rights of DKI Jakarta has formed a Working Group on Legal Analysis and Evaluation of DKI Jakarta Regional Regulation Number 6 Year 2015 on Tourism. DESMA Center is a member of the working group.

 

The House of Representatives passed Law Number 11 of 2020 on Job Creation on 5 October 2020, which was subsequently promulgated on 2 November 2020. The Job Creation Law is the first legal product in Indonesia with the concept of Omnibus Law. The logical consequence of the enactment of the Job Creation Law is the establishment of implementing regulations that will elaborate further provisions regarding the regulated substance.

 

Thus, it will certainly change the laws and regulations at the regional regulation level. Apart from the impact of the Job Creation Law, there are several provisions in Regional Regulation No. 6/2015 on Tourism that are no longer relevant. Ideally, the plan for drafting regional regulations affected by the Job Creation Law should be prepared by paying more attention to the characteristics of regional specificity, in this case DKI Jakarta Province.

 
 
As part of the Pokja's workplan in conducting Legal Analysis and Evaluation of DKI Jakarta Regional Regulation Number 6 Year 2015, the Pokja has conducted a series of meetings. As a follow-up to the first meeting that took place on 13 April 2022, representatives of the working group team from the DKI Jakarta Regional Office of the Ministry of Law and Human Rights held a discussion with the DESMA Center team at the DESMA Center office in Central Jakarta on 25 May 2022. Throughout the discussion, strategic issues related to tourism investment, especially sustainable tourism investment as well as challenges and opportunities for DKI Jakarta's tourism development were discussed.
 
The result of this evaluation analysis is a recommendation on the status of existing laws and regulations whether they need: (1) improvement (revision); (2) replacement (revoked); or (3) maintained.
